If you have an argumentative or difficult relationship with your landlord, you may be wondering if he or she has the right to evict you. There are several reasons why a landlord may bring an eviction suit against you. Three of the most common are overdue rent, expiration of lease, or breach of lease.
If you have missed a rent payment, the state of Pennsylvania gives you a 10 day grace period to either pay the past due rent or move out of the living space before your landlord can file for eviction.
If your lease has expired, do NOT ignore it or assume that your landlord doesn’t care if you continue to live on their property. ALWAYS speak to your landlord to see if you have the option of extending your lease before it runs out.
Your individual lease will determine what qualifies as a breach of the lease - for example, if your lease states “no pets” and you have a dog or cat, this is a breach of your lease and your landlord does have the right to evict you. The same would go for any other specific dos or don’ts that have been blatantly ignored or overlooked.
